Tax :

  • ITC Excise Case - This was the largest excise demand in India running into over Rs. 800 Crores. Mr. Sagar was a senior member of the team for the assessee. The case was finally decided by the Supreme Court of India in favour of the assessee.
  • PanAmSat (US Satellite Company) – Income Tax demand in the region of USD 75 million. The case was settled consequent upon client’s success before the Income Tax Appellate Tribunal, New Delhi.
  • A Hong Kong based Major Corporation: Demand under the Indian Income Tax Act for a total amount of Rs.12.5 Crores (approx.).
  • Mayo College, General Council: service tax law.

Competition Commission :

  • Handled some of the leading cases in the Competition Commission (till recently known as the Monopolies and Respective Trade Practices Commission). Clients include major tyre manufacturing companies of India such as Good Year India Ltd., CEAT Ltd., J.K Industries Ltd., MRF Ltd. and Modi Tyres. Other clients (before the Competition Commission) included Hindustan Lever Ltd. (now Hindustan Unilever Ltd.), Britannia Industries Ltd., Parle Industries Ltd. and ITC Ltd. Types of matters handled include cartelisation, restrictive trade practices and unfair trade practices. Also handled cases relating to setting up of new units; expansion of undertaking and concentration of economic power.

Business Crimes :

Mr. Sagar regularly represents leading corporate entities in criminal matters:

  • Bofors - Represented the major Swedish arms manufacturer, A.B. Bofors of Sweden (formerly of the Akzo Nobel Group). This was a very high profile case involving allegations of graft and dragging some of the highest politicians of the land into the controversy.
  • Acting for a major Korean construction company in relation to a bridge collapse case which led to loss of 48 lives; represented a U.K based University in a criminal complaint filed by its erstwhile partner in the State of Tamil Nadu; representing a Hong Kong based metro railway company relating to a project in India; handling criminal complaints on behalf of a leading Hong Kong based infrastructure company.

Other litigation (illustrative list) :

  • Representing a Mid East Government Company in an ongoing SIAC arbitration against a leading multinational bank for a claim of USD 65 million involving issues of fraud and misrepresentation.
  • Currently representing clients before the Hyderabad courts in a road construction matter.
  • Currently handling an arbitration before a former Supreme Court Judge of India on behalf of the State of Madhya Pradesh arising out  of computerization of State Agricultural Marketing Board operations where claim amount is in excess of USD 20 Million.
  • Union Carbide Bhopal Gas Leak Case – this was the largest damages case in the world. Mr. Sagar was a senior members of the team representing Union Carbide.
  • Represented BPL Limited, Usha Martin and RPG in the High Court of Delhi and Supreme Court of India in the mobile telecom license case.  Represented a large liquor manufacturing company in India in a “Trade marks” case against a famous and internationally renowned scotch manufacturer of Scotland. This case was ultimately settled.
  • Represented a Malaysian Oil & Gas Company in a tender dispute against ONGC in a USD 600 million tender.
  • Advising British American Tobacco (U.K.) on issues relating to sale of tobacco products and health warnings.
