Ankit Khushu
Ms. Khushu graduated from Amity Law School, IP University, Delhi and was ranked amongst the top students of the University. She enrolled as a lawyer in 2008. Her practice focuses on infrastructure projects, arbitration and litigation.
She is the firm’s chief coordinator for ‘ArbExcel’ – an all-India essay writing competition for law students – and also for the South Asia regional rounds of the Foreign Direct Investment Arbitration Moot competition (organised and sponsored by Kachwaha & Partners).

Professional Experience:
1. Advisory:
- Currently advising a Korean EPC Contractor on multi-million dollar claims against State Government entities arising out of two thermal power plant projects.
- Currently advising a leading Indian manufacturer of Indian Railway tracks and equipment on various agreements for development and transfer of technology.
- Involved in advising the International Finance Corporation (World Bank Group) on boosting tourism infrastructure in the Buddhist Circuit.
- Involved in advising the Ford Foundation in relation to multi-million dollar loan agreements with Indian parties (micro financing sector).
2. Arbitration:
- Lead counsel for an engineering consultant before a three member arbitral tribunal in a National Highway construction dispute (on going arbitration)
- Lead counsel for a Medical Robotics Engineering Company in an arbitration against an investor arising out of related Share Holders Agreement and Share Subscription Agreement. (on going arbitration).
- Lead counsel for a Delhi based engineering company in an institutional arbitration concerning a Purchase Order (failure to deliver goods).
- Lead counsel for an engineering company in an arbitration against its sub-contractor (under the Rules of the Delhi International Arbitration Centre)
- Assisted as Senior Associate in a high value international commercial arbitration representing a Mid-east Government Company. The sums unanimously awarded were approx. US$ 197 million.
- Assisted as Senior Associate in an arbitration before a three member Tribunal comprising of former judges of the Supreme Court of India, where disputes arose under a National Highway Project. The client was a joint venture between a Canadian company and an Indian company.
- Assisted as Senior Associate in a Singapore seated arbitration (SIAC Rules) arising out of a construction project for a major Korean construction company.
- Assisted as Senior Associate in an ICC arbitration, acting for a major Australian mining corporation against a Government of India Company in a breach of contract action. An award of over US$ 100 million was rendered in favour of client.
- Assisted as Senior Associate in a Mumbai seated arbitration arising out of EPC Contract (power plant) where the claim amount was in excess of Rs. 800 crores. (The matter was ultimately settled).
- Assisted as Senior Associate in an arbitration on behalf of a Malaysian Construction Company arising out of a road construction project where claim amounts exceeded US$ 40 million.
- Assisted as Senior Associate in a Chandigarh seated arbitration on behalf of a Malaysian Construction Company arising out of a road construction project against the State of Haryana. The claims and counter claims were around US$ 18 million.
- Assisted as Senior Associate in an institutional arbitration arising out a Diesel Hydrotreater Project in Northeast India. An award of US$ 4 million was rendered in favour of the clients.
3. Litigation:
- Handling proceedings on behalf of an Australian Mining Company against the Government of India for enforcement of an ICC Award for an amount of over US$ 100 million before the Delhi High Court.
- Independently handled proceedings on behalf of a French Telecom Company for enforcement of a foreign award rendered by the London Court of International Arbitration for an amount of over US $25 Million.
- Represented a subsidiary of an Indian Power company (Operational Creditor) in CIRP proceedings against a Turkish company before the National Company Law Tribunal.
- Defended multiple proceedings before the Debt Recovery Tribunal for a Mid-East Investor company where the stakes exceeded Rs. 400 crores.
- Assisted in successful enforcement of a US$ 18 million Award rendered in favour of an Indian construction company relating to design and construction of 54 major bridges on the Western Freight Corridor.
- Assisted the Senior Partner in writ proceedings before the Delhi High Court wherein he was appointed as amicus curiae. The issue pertained to statutory breach of duties by electricity companies and resultant damage claims.
- Assisted the Senior Partner in Vodafone – India Bilateral Investment treaty arbitration dispute before the Delhi High Court wherein he was appointed as amicus curiae. (Reported judgment at 2018 SCC Online Del 8842).
- Assisted in the leading Supreme Court case of Yograj Infrastructure Ltd. v. Ssangyong Engineering Co. (2011) 12 SCC 359 wherein the Court ruled on implied exclusion of Part I even if the agreement is subject to laws of India (if the seat is Singapore and arbitration is to be conducted in accordance with SIAC Rules).
- Assisted in the Constitutional Bench decision of the Supreme Court in Bharat Aluminium Co. Ltd. v. Kaiser Aluminium Technical Service Inc. (2012) 9 SCC 552 which resulted in overriding certain previous decisions of the Supreme Court.
Positions of responsibility in the Firm:
- Chief Program Coordinator of the South Asia Regional rounds of Foreign Direct Investment Arbitration Moot Court Competition organized and sponsored by the firm since 2012.
